    TERMS OF USE FOR EARTHSURE BREWER SOFTWARE
    OWNERSHIP OF EARTHSURE PROGRAM
    The not-for-profit Institute for Environmental Research and Education (“IERE”) owns and
    manages environmental product declaration (“EPD”) program called Earthsure®, the first such
    program in the United States. In support of that program, IERE has developed the Earthsure
    Brewers program, an online automated system for producing EPDs for the Beer Industry.
    Payment of fees provides access for one person (“seat”) to use the software. Use of this program
    does not imply ownership. You (the organization paying for access to the Earthsure Brewer
    program) may not extract, repackage, resell or reverse engineer the content of the Earthsure
    Brewer software or its output.
    CONFORMITY WITH APPLICABLE STANDARDS
    This software was developed in conformity with the ISO 14025 and ISO 14044 standards for life
    cycle assessment and EPDs, and IERE’s General Program Instructions. The software has been
    validated and IERE as the program operator publishes and maintains the underlying Product
    Category Rule, and all EPDs developed from them.
    ACCURACY OF DATA AND RESULTS
    Life cycle assessment is a technically demanding and complex activity. IERE has taken due care
    in developing the background data and models supporting the Earthsure Brewer software, and
    will continue to do so in maintaining and updating the data and software and any supporting
    documentation. IERE does not warrant that the EPDs are without error. LCAs provide estimates
    of potential environmental impact, and they do not predict impacts on category endpoints,
    exceeding thresholds, safety margins or risks.
    As a user, you agree to do your best to provide accurate, complete and current data as inputs to
    the software and the resulting EPDs. For the purpose of data validation and review, you agree to
    allow IERE to audit your processes, books and records at IERE’s sole discretion, upon three days
    written notice. You will work with IERE to correct any errors in the data provided. Any
    discovery by IERE of fraud will result in the removal of your brewery from the program.
    CONFIDENTIALITY AND PRIVACY
    The Earthsure Brewer and IERE collect personal and company confidential information in order
    to provide the services of the EPD software. Personal information may include your name and
    address as well as your credit card information. Company confidential information includes your
    location(s), vendors, and details of your processes, as well as your recipes. IERE has taken all
    due care to maintain the security of the data you input into the software.
    IERE will not share or sell your personal or business confidential information with unrelated
    third parties.
    IERE will use this information internally in order to provide services, and it may share it with
    IERE vendors including our credit provider and software engineering provider in order to
    properly bill for its services and to provide support to the software.
